I received the JSD “Francophonie” grant to research the role of Free Trade Agreements on the protection of authors’ rights. It’s interesting to see how the free trade agenda, coupled with the massive investor-state dispute settlement (ISDS) and the investment court system, has reshaped the legal concept of authors’ rights. Whereas IP Law is mainly concerned with the protection of intellectual property, ITD relies on the protection of the right to property. In the following years, the free trade agenda became a normative driver of intellectual property law. This shift in the legal concept of IP Rights is connected to the broader question of the legal concept of property. I will show how the rise of investor-state dispute settlement (ISDS) has reshaped the legal concepts of property and cultural property. I will argue that these legal changes are connected to the rise of the GAFA, i.e. of the US, China, and the European Union. These three actors are the main actors in the global economy. The rise of populism in Europe and the United States, the Russian annexation of Crimea, the terrorist attacks in France, the Brexit referendum, the United Kingdom’s exit from the European Union and the Trump campaign made people question their leaders and their institutions. Trust was a frequent topic of discussion in the open market. In an environment of hyper-protectionism, a more open market was considered necessary to fight the rise of protectionist trade practices. The idea was to attract investors and businesses by developing the open market. But a new round of global populism made the focus of Trust, and of diplomacy more generally, the core of global governance.
